Terms of Use
The term “KMS” means Knowledge Management System
The following Terms of Use apply to the terms and conditions in which the CIRAD makes the KMS portal www.swm-programme.info and its services available to Users, and to Visitors access to the KMS portal and use of its services.
Any visit of the KMS portal is subject to the present Terms of Use.
Therefore, by using this KMS portal, Users accept all following terms and conditions. Users must refrain from visiting this KMS portal if they do not accept these Terms.
Access to the KMS portal
By using this KMS portal, Users acknowledge having made sure that their device is exempt from any virus and in perfect operating condition.
Users are kindly reminded that the confidentiality of correspondence cannot be guaranteed on the Internet network and that every Internet user is responsible for taking all appropriate measures to protect their own data and/or software from contamination by any viruses that may be circulating on the Internet.
The CIRAD shall not be held responsible for any direct or indirect damages due to access, use or content loading on the KMS portal such as a virus infecting Users’ computer or any other device.
The CIRAD does everything possible to ensure available access to the KMS portal on a 24/7 basis, except from a case of force majeure or an event beyond its control, excluded potential breakdowns or maintenance operations required to secure the well-functioning of the KMS portal and its services.
Therefore, the CIRAD can guarantee neither the availability of the KMS portal and/or services nor transmissions reliability or performance regarding response time or quality. No technical assistance by telephone or electronical means is provided to Users.
The CIRAD shall not be held responsible in case of unavailability of the KMS portal and/or the use of the services.
The CIRAD may also interrupt access to the KMS portal or all or part of the services at any time and without notice, without producing any ground of compensation. Users acknowledge and agree that the CIRAD is not liable for any interruption and its consequences for Users or any third party.
Content of the KMS portal
The views expressed on the Sustainable Wildlife Management (SWM) Programme KMS Portal (hereafter referred to as the KMS Portal) can in no way be taken to reflect the official opinion of the European Union, FAO or its Member States.
The information on the KMS Portal is provided for the convenience of users. Hence, FAO, CIFOR, WCS and CIRAD are not responsible for its accuracy, nor for any use of such information by users.
The mention of specific companies, institutions, services or products on the KMS Portal, does not imply that these have been endorsed, accredited or recommended by FAO, CIFOR, WCS or CIRAD.
The designations employed and the presentation of material, including but not limited to maps, through the KMS Portal do not imply the expression of any opinion whatsoever on the part of FAO, CIFOR, WCS or CIRAD, concerning the legal or development status of any country, territory, city or area or of its authorities, or concerning the delimitation of its frontiers or boundaries.
Under no circumstances shall FAO, CIFOR, WCS or CIRAD, or any of their respective subcontractors, bear responsibility to any user or third parties for any misrepresentation, inaccuracy, error, omission, deletion, defect, alteration of any content posted in the KMS Portal, or for its timeliness or completeness.
FAO, CIFOR, WCS or CIRAD shall not be liable for any claim, loss or damage arising from, or directly or indirectly connected to, the use of, reference to, or reliance on any content provided in the KMS Portal, including, but not limited to, any liability arising from any intentional or negligent misuse, errors, disclosure, undue transfer, loss or destruction of data that may occur.
FAO, CIFOR, WCS and CIRAD reserve the right at any time to modify or discontinue the KMS Portal, temporarily or permanently, including any means of accessing or utilizing it, at their sole discretion with or without prior notice to users.
Intellectual property
FAO, CIFOR, WCS and CIRAD merely provides a tool to the users allowing them to collect information and other relevant content. Copyright of the material available on the KMS Portal remains with the individual information provider(s) or original rights holder(s). Where specific authorization to reuse and redistribute material is required, users must obtain the necessary permission from the respective rights holder(s).
The present KMS portal and its general structure are the sole property of the CIRAD, legally protected as such under intellectual property legislations (copyright, data bases, software, brands, etc.).
Any reproduction, representation or adaptation, by any mean, of all or any part of the KMS by a natural or legal person, without express prior authorisation of the CIRAD is strictly prohibited and would constitute an act of counterfeiting punishable by law, notably section L. 335-2 of the French intellectual property Code.
Any reutilisation or extraction, by any mean, of all or any part of the KMS portal data base by a natural or legal person, without express prior authorisation of the CIRAD is equally prohibited and would constitute an act of counterfeiting punishable by law, notably sections L. 343-1 and following of the French intellectual property Code.
Any reutilisation of all or any part of CIRAD brands or logos without express prior authorisation is prohibited and punishable by law, notably under sections L. 713-2 and following of the French intellectual property Code.

Hyperlinks to external websites available on the KMS Portal, do not imply any official endorsement of or responsibility on the part of FAO, CIFOR, WCS or CIRAD for the opinions, ideas, data, products or activities, or the validity of the information provided on those websites. Hyperlinks to external websites are provided for the convenience of users only, to indicate further information available on related topics. Such information is provided on the basis that users accessing the platform assume responsibility for assessing its relevance, accuracy and suitability for application.
Personal Data Protection
In accordance with French Data Protection legislation (Loi “Informatique et Libertés” of January, 6th 1978 in its reviewed version) and with the General Data Protection Regulation (GDPR) n° 2016/679/UE of April, 27th 2016, the CIRAD ensures privacy for the Users on the KMS portal.

Amendment of the Terms of Use
FAO, CIFOR, WCS and CIRAD may reserve the right to amend the present Terms of Use at any time and without notice in order to adapt them to the evolvement of the KMS portal, its services, and its operation.
Governing Law and competent courts
These Terms of Use and the content of the KMS portal are regulated by French Law.
The parties agree that any conflict that could not find an amicable settlement will be submitted to competent French courts.
Personal Data Protection
The CIRAD, as data controller, ensures the privacy of the Users on the KMS portal, in accordance with reviewed French “Informatique et Libertés” Law n°78-17 of January 6th 1978 and EU General Data Protection Regulation n° 2016/679 of April 26th 2016 (hereafter “GDPR”).
Personal data processing operations
Users are hereby informed that personal data communicated through the KMS portal or its services may be processed in accordance with a contract, as part of the CIRAD’s legitimate interest, or prior to Users’ consent, in order to handle a request (contact, registration, newsletter subscription…).
Information thus collected may be used only by authorised CIRAD agents or contractual processors, as far as needed for indicated purposes. Such information is neither communicated to third parties, nor retained any longer than necessary to achieve those purposes, without prejudice to applicable storage obligations.
The information gathered by means of the contact form of the KMS portal will be kept for the time it takes to process requests, and then for an additional year to enable statistics to be produced. Those data are intended for the sole use of the SWM communication team.
Personal data security
In any case, the CIRAD implements appropriate technical and organisational measures in order to ensure an adequate level of security for personal data collected and processed on the KMS portal or through associated services.
Data subjects’ rights
Users have a right to ask for personal data access, rectification, erasure, restriction, portability (when applicable) and to object. These rights may be exercised writing to the CIRAD GDPR team, via email (dpo@cirad.fr) or postal mail (DPO - Direction Régionale Montpellier Occitanie - Avenue Agropolis - TA 178/04 - 34398 Montpellier Cedex 5 - FRANCE). Data subjects also have a right to place a request with the CNIL, French data protection authority.
Users also have a right to indicated wishes concerning handling of their personal data in the event of their death. For such indications, please contact the CIRAD GDPR team as indicated above.
Users responsibility
Users acknowledge they are bound to follow GDPR when visiting the KMS portal and using its services, notably by abstaining from collecting and / or unlawfully using persona data thus accessed.
Cookies and analytics
This KMS portal is set up to be able to use Matomo which is an Open Source tool recommended by the CNIL. Matomo uses "cookies", which are text files placed on your computer, to help the KMS portal analyze how users use the site.
Use of cookies
The information generated by the cookies about your use of the KMS portal (including your IP address) will be transmitted to our tool Matomo, which is hosted and administrated by CIRAD in France. CIRAD will use this information for the purpose of evaluating your use of the KMS portal, compiling reports on KMS portal activity. CIRAD will not associate your IP address with any other data held by CIRAD. Your IP address will be anonymized in Matomo.
This KMS portal uses cookies that are processed by CIRAD in accordance with the following conditions and for the purposes described above. You can set up the use of cookies by selecting the appropriate option below. You may deactivate or restrict the transmission of cookies by changing the settings of your web browser. Cookies that are already stored may be deleted at any time.

Nothing in these Terms and Conditions, nor any acts performed or statements made in relation to the KMS Portal, shall be deemed as a waiver, express or implied, of any of the privileges and immunities of FAO, or as its acceptance of the applicability of any national laws, or of the jurisdiction of the courts of any country over disputes arising out of, or in connection with, these Terms and Conditions.
