Section 2 (extract) -
In this Act— (…)
“Minister” means the Minister of Agriculture or any other Minister to whom the
President may, from time to time, assign the administration of this Act;
“registering officer” means a registering officer appointed in terms of section three;
Section 3 -
Subject to the law relating to the Public Service, the Minister shall appoint one or more registering officers for the purposes of this Act.
Section 2 (extract)
In this Act—
“Agency” means the Environment Management Agency established by section nine;
“Minister” means the Minister of Environment and Tourism or any other Minister to whom the President may, from time to time, assign the administration of this Act;
Section 9 (extract) -
There is hereby established an Agency, to be known as the Environmental Management Agency, which shall be a body corporate capable of suing and being sued in its own name and, subject to this Act, of performing all acts that bodies corporate may by law perform.
Section 10 (extract)
(1) Subject to this Act and any other enactment, the functions of the Agency shall be -
(a) to formulate quality standards on air, water, soil, noise, vibration, radiation and waste management;
(b) to assist and participate in any matter pertaining to the management of the environment; and in particular (...)
(2) Before formulating the quality standards in terms of paragraph (a) of subsection (1), the Agency shall consult any other Minister, association, agency or authority it considers has responsibilities relating to the standards concerned
Section 4 -
There is hereby established an authority, to be known as the National Biotechnology Authority, which shall be a body corporate capable of suing and being sued in its own name and, subject to this Act, of performing all acts that bodies corporate may by law perform.
Section 5 -
(1) The general function of the Authority shall be to advise the Minister on all aspects concerning the development, production, use, application and release of products of biotechnology, and ensure that all activities with regard to such development, production, use, application and release are performed in accordance with this Act.
(2) The Authority shall have the following specific functions—
(a) to evolve a long-term policy for safety in biotechnology in Zimbabwe;
(b) to actively promote biotechnology research, development and application in Zimbabwe;
(c) to review project proposals concerning high risk category organisms and controlled experimental trials involving them, and make decisions on whether to approve, prohibit or restrict such trials;
(d) to review reports of all ongoing approved projects and controlled experimental trials involving high risk category organisms;
(e) to approve deliberate releases of properly evaluated products of biotechnology;
(f) to approve the large-scale use of products of biotechnology in industrial production and application;
(g) to assist in the clearance of applications for setting up industries based on the use of products of biotechnology;
(h) to monitor and approve the discharge of biological waste from laboratories and hospitals into the environment;
(i) to ensure that biotechnology guidelines and standards are adhered to generally and in the execution of projects or controlled experimental trials involving high risk category organisms;
(j) to recommend training programmes for biosafety officers;
(k) to identify, prioritise and propose areas for standardisation of products of biotechnology to the Standards Association of Zimbabwe, the Medicines Control Authority of Zimbabwe, the Environmental Management Authority and other relevant bodies;
(l) to approve the safety aspects of the import, export, manufacture, processing and selling of any products of biotechnology, including substances, foodstuffs and additives
containing products of biotechnology;
(m) to advise the customs authorities on the import and export of biologically active material and products of biotechnology;
(n) to collect and disseminate information pertaining to safety procedures associated with work on or research into modern biotechnology;
(o) to establish contact and maintain liaison with bodies in other countries and international organisations concerned with monitoring work on or research into biotechnology;
(p) to perform such other functions as are provided for in this Act.
Section 91 -
A catchment council may within an existing scheme allocate water for use for primary purposes, agricultural purposes, institutional purposes or miscellaneous purposes on land within the area of the scheme for the benefit of the participants in the scheme.
Section 16 -
(1) The Minister may make regulations providing for all matters which, by this Act,
are required or permitted to be prescribed or which, in his opinion, are necessary or
convenient to be prescribed for carrying out or giving effect to this Act.
(2) Regulations made in terms of subsection (1) may provide for—
(a) regulating and controlling the manner in which the trade or business of
slaughtering animals shall be carried on;
(b) regulating and controlling the manner in which animals may be
exhibited and the manner in which the business of selling animals or caring for
animals belonging to other persons shall be carried on;
(c) regulating and controlling the manner in, and conditions under which,
wild animals shall be kept in captivity;
(d) regulating and controlling the manner in which the business of a
horse-riding establishment shall be carried on;
(e) regulating and controlling—
(i) the transportation or movement of animals; and
(ii) the hawking of animals; and
(iii) the keeping of domestic animals;
and
( f ) the registration or licensing of any trade, business or premises referred
to in paragraphs (a) and (b) and the payment of fees for such registration or such
licensing. ower of police officer or inspector to remove animal for treatment
(1) If a police officer or inspector finds any animal which is so diseased or injured or
is suffering in such other way that in his opinion it is desirable that it should receive
treatment in order to relieve its suffering, he may, if the owner is absent or refuses to
consent to the treatment of the animal, at once summon a veterinary surgeon or, if any
veterinary surgeon is within reasonable distance and if the animal can without causing
it unnecessary suffering be moved, take it or cause it to be taken to the veterinary
surgeon for such treatment.
(2) Any expenses which may reasonably be incurred by reason of any action taken by
a police officer or inspector under subsection (1), including the expenses and fees of
any veterinary surgeon, may be recovered from the owner as a civil debt.
Section 102 (extract) -
(1) Subject to subsection ( 4), a local authority in co-ordination with the ministry of health and veterinary department may inspect any meat slaughtered at a slaughterhouse licensed by it or any meat intended for sale within its district and may charge fees at a rate approved by the Minister for such inspection.
Provided that if inspection fees ha Ye been charged in respect of any inspection of meat by another local authority or inspector appointed in terms of regulations or by such competent authority outside the borders of Zimbabwe as may be prescribed by regulation, no further inspection fees shall be charged.
Section 4 (extract) -
In this Act— (…)
“authorized person” means a person authorized in terms of paragraph (b) of subsection (1) of section twenty to do anything or perform any act which may be done or performed in terms of this Act;
“Director” means the officer in charge of the Department of Veterinary Services of the Ministry;
“Minister” means the Minister of Agriculture or any other Minister to whom the President may, from time to time, assign the administration of this Act; (...)
Section 5 -
(1) For the better eradication and prevention of the occurrence or spread within Zimbabwe and for the prevention of the introduction into Zimbabwe of diseases and pests the Minister may, by regulation, order or notice in a statutory instrument, do any or all of the matters or things specified in the Schedule.
(2) Nothing in this Act shall be construed as precluding the Minister, in the exercise of the power conferred upon him by subsection (1), from making provision for the eradication and prevention of the occurrence or spread amongst human beings of—
(a) a disease common to human beings and animals; or
(b) a pest injurious to both human beings and animals or capable of introducing or spreading amongst both human beings and animals a disease referred
to in paragraph (a).
Section 20 (extract) -
(1) The Director may—
(a) with the approval of the Minister, delegate to a person any power conferred upon him by this Act in relation to a particular matter or class of matters or otherwise; (...)
Section 21 (extract) -
(1) An authorized person may, in the performance of his duties under this Act, enter any land or vehicle and take with him such persons, animals, vehicles, appliances,
instruments, tools, drugs and other things as he may consider necessary for the performance of his duties and there—
(a) do anything which he is authorized or required to do in terms of this Act; and
(b) supervise and inspect the doing of anything which any other person is required to do in terms of this Act (...)
Section 84 -
(1) If the Minister is of the opinion that such action is necessary or desirable in the interests of fish conservation he may, on the recommendation of, or after consultation with, the Authority, by notice in a statutory instrument, declare any waters to be controlled fishing waters and may in like manner amend or revoke any such notice:
